An Osogbo Federal High Court has granted order for substituted means of service on the Peoples Democratic Party, PDP and its candidate, Adeleke Ademola Nurudeen Jackson for the forthcoming July 16 governorship election.
The exparte injunction was granted on Thursday, 31st March, 2022 by Hon. Justice N. Ayo Emanuel.
In a Suit FHC/Os/Cs/27/2022 by Boot Party, BP and its governorship candidate, Prince Adesoji Adeleke, the Plaintiffs have approached the court to restrain the Independent National Electoral Commission, INEC from recognising PDP and Ademola Adeleke to participate in the forthcoming governorship election in Osun State for having conducted its primary election in a total disregard to valid court decisions and in gross violation of the law.
The Plaintiffs stated that the PDP conducted the primary election which produced Adeleke Ademola as its governorship candidate in a flagrant disrespect to the provisions of the Constitution and the Electoral Act, 2022.
They also prayed, among other reliefs, the court to restrain the PDP from fielding any other Governorship candidate and also the INEC from receiving from them any other candidate for the Osun State governorship election slated to hold on July 16, 2022 or any other date thereafter.
The Originating summons is dated 19th and filed on 21st March, 2022 by the Plaintiffs’ counsel, Muhydeen Adeoye Esq.
According to the Suit, the Plaintiffs are praying the Federal High Court to pronounce on whether the 1st Respondent (INEC) is under a legal duty to acknowledge and obey tenor of a valid judgment of a competent Court of law and where same is resolved in the affirmative, whether the primary election conducted by the 2nd Respondent (PDP) and which produced the 3rd Respondent (Adeleke Ademola) in gross neglect and disobedience to the said judgments is valid and ought to be recognized by any persons or government institutions in line with the provisions of the 1999 Constitutional (as amended) and the Electoral Act, 2022.
Meanwhile, the Court has also granted an ex parte relief to the Plaintiffs to serve the respondents by substituted means by pasting the court process on the wall of the State Secretariat of the Second and Third Respondents.
The matter was then adjourned to 3rd of May, 2022 for hearing of the suit.
